Affiliate Agreement for www.TheMakeMoneyShop.com

This agreement describes the entire terms and conditions for participation in the TheMakeMoneyShop.com Affiliate Program.

This Agreement contains the complete terms and conditions which you (the "Affiliate") agree to be bound by as a participant in www.TheMakeMoneyShop.com.com affiliate program (the "Program") and which shall apply once your application to participate in the Program has been accepted by www.TheMakeMoneyShop.com, Inc..

In this agreement, the term "Affiliate" refers to you (the applicant).  Wherever the agreement refers to "you" or "your", it means "the Affiliate"; "we" or "our" refers to TheMakeMoneyShop.com.

Affiliate Site

TheMakeMoneyShop.com will create a unique URL for you when you join at any membership level. All members of TheMakeMoneyShop.com  are automatically registered as an affiliate but not required to participate in the affiliate program.

Commissions

Affiliates of TheMakeMoneyShop.com will receive 50% of the revenue as a commission on active paying memberships ordered through your Affiliate link. For a sale to generate a commission to an Affiliate, the customer must remain active and remit full payment for the membership level ordered. Commissions will only be paid on sales which are made through qualified Affiliate links.

Affiliate payments are made on or around the first Monday of each month. Payments are for earnings from the previous month. For example, commissions for any sales made in January will be paid on or around the first Monday of February. Commissions relating to fraudulent payments, refunds, etc. will be deducted before commissions are paid. All commissions are paid in US dollars via Paypal.com. There is currently no alternative option for payment.

No commissions will be paid to members signing up under their own affiliate link. Doing so could lead to termination of your membership and banning from TheMakeMoneyShop.com membership indefinitely.

Payment

Commissions are paid for the preceding month on the first month of each month.  Commissions are paid via Paypal directly to an affiliates Paypal email provided that the Paypal email is submitted to TMMS as an affiliate payout email.  Links and instructions to ensure submission of affiliate's PayPal email are provided within the membership area of TheMakeMoneyShop.com website.

If any order that generated a referral fee is refunded to the customer for any reason at the discertion of TheMakeMoneyShop.com, the amount will be deducted from the affiliate total payment amount. Deductions may occur within the same month or months following any refund granted.


Order Fulfillment

TheMakeMoneyShop.com will be solely responsible for processing every order placed by a customer on the Affiliate Site.

Customers/Members

Customers who purchase products, services and or membership subscriptions through the Affiliate Program will be deemed to be customers of TheMakeMoneyShop.com.  Accordingly, all TheMakeMoneyShop.com rules, policies, and operating procedures concerning customer orders and service will apply to those customers.  We may change our policies and operating procedures at any time.  Prices and availability of our products, services  and/or subscription may vary from time to time. TheMakeMoneyShop.com policies will always determine the fees paid to the affiliate.

Qualification for Commissions

Affiliates must have an active Affiliate link in order to qualify for commissions and be an active member of Themakemoneyshop.com.
 

Qualification To Remain Active

Affiliates must present and maintain an active membership at TheMakeMoneyShop.com as well as an email account that will receive emails from TheMakeMoneyShop.com. Any email addressed that return emails as undeliverable or any action to opt out of emails received from TheMakeMoneyShop.com may result in deletion of the affiliate's membership with subsequent loss of commission and termination of an affiliate account at any time and at the sole discretion of TheMakeMoneyShop.com. Commissions earned may or may not be paid upon termination of an affiliate account.

Qualifying Sites

TheMakeMoneyShop.com reserves the right not to accept any site or individual into the Affiliate Program based on site content.  Sites that Do Not Qualify for the TheMakeMoneyShop.com Affiliate Program include sites which:

Unsolicited Commercial E-mail or SPAM

TheMakeMoneyShop.com in no way participates in mass unsolicited emailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well.   Violation of this policy will result in the termination of this contract and immediate dismissal from the TheMakeMoneyShop.com Affiliate Program, with no refund. Bottom line: If you spam you're out!

Use of Traffic Exchanges

TheMakeMoneyShop.com does not expressly forbid participation by affiliates in traffic exchange programs but does retain the right to immediately and without notice close any affiliate account and withhold commission payments to any affiliate found to be using any traffic exchange program that uses excessive bandwidth from TheMakeMoneyShop.com server, frames any page of TheMakeMoneyShop.com website and/or results in use of email accounts that return as undeliverable by a large number registrants under affiliates links with a "large number of registrants" being wholly determine by TheMakeMoneyShop.com .

Use of Video Tutorials, Framed Pages and Copyrighted Content

TheMakeMoneyShop.com reserves the right to immediately and without notice close any affiliate account and withhold commission payments to any affiliate found to be framing pages of TheMakeMoneyShop.com and/or hosting any instructional videos provided on TheMakeMoneyShop.com website and/or copying content from and pages of TheMakeMoneyShop.com both within the membership pages and public areas of TheMakeMoneyShop.com.

Use of Ads Provided By TheMakeMoneyShop.com

TheMakeMoneyShop.com provides hotlinked ads and ad copy to active affiliates for promotional use so long as said ads are not used on  non-qualifying sites listed above with the understanding that there are no reimbursements of fees or expenses acquired with use of said ads under any circumstances or conditions.

Relationship of Parties

You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties.  You will have no authority to make or accept any offers or representations on our behalf.  You will not make any statement, whether on your site or otherwise, that reasonably would contradict this statement.

Limitation of Liability

We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to you under to this Agreement.

Disclaimers

We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the Affiliate Program.  In addition, we make no representation that the operation of our site or the Affiliate links will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

Any disputes between the parties to this agreement which involves interpretations of the terms of this agreement shall be submitted to arbitration under the rules of the American Arbitration Association, and the finding of the Arbitrator shall be binding on all parties.  You may not assign this Agreement, by operation of law or otherwise, without our prior written consent.  Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns.  Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

By signing up with TheMakeMoneyShop.co affiliate program and/or submitting your payout PayPal email for affiliate payments,  you acknowledge that you have read this agreement and agree to all its terms and conditions.  You have independently evaluated this program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.
